I am a hospice social worker for a really small Home Health & Hospice company in Utah. I recently made a career change and have only been employed by said company for 5 weeks.
Last week, my boss pulled all of the “field staff” (about 5 of us) into a last minute meeting and let us know that we all needed to download an app that we would use to clock in and out (I am a full-time, salaried employee per my contract) and that would also be used to track our mileage from patient to patient. She also mentioned she “wouldn’t be obsessively checking our location”.
I downloaded the app, but immediately turned off the “share location” settings. Every day since, she’s been sending us reminders to clock in and I have not yet done so. The day after this was introduced, I met with her privately and let her know that I was uncomfortable with this and wouldn’t be sharing my location with her. She didn’t give any concrete response and told me to keep an open mind.
Important to note, I was not given a company phone OR vehicle. I use my personal phone and vehicle and was told I’d be receiving a $40/mo phone stipend and a $0.45/mi mileage reimbursement.
This Monday, she messaged me around 11am (my work day starts at 9am) asking if I “was working today?”, which I was. She has never asked this before. Then yesterday, I received a message from HR asking to meet with me today.
I am assuming that this meeting is due to my refusal to share my location with my boss/the company. I am uncomfortable doing this for multiple reasons and had this been disclosed to me prior to my hire, I wouldn’t have accepted the position.
What options do I have here? Can they require me to do this?
TLDR; my boss wants me to turn on GPS tracking of my personal phone while I drive my personal vehicle to see patients for work.
