Texas state agency firing

My son was flagged for dui while driving a state vehicle. He hadn't been drinking and when taken to the station had negative breath and blood tests BUT the cops notified the state (since he was in their vehicle working for them). He reported it to his boss who said that HR for his agency wants him fired immediately. He wants to go to grad school and was planning on doing that while working at this same job but now…. So, do you think it's better for him to just resign rather than getting fired? Especially since he wants to work in the same field after grad school and even possibly for this sales rate agency. Thanks.
