This has to be illegal.

My(40f) boyfriend (46m) goes out of town to work. He fixes and repairs machinery. When upon his hiring he was told Not in writing that he gets a 60$ day per diem when out of town (so many miles from our city justify as out of town. Now here is where it gets sticky) Over the years they played around with his per diem. At first they would cut him a no tax cut check for days he would be out of town, and if he came back a day or two early the money would be taken off next trip out of town. Now he did not have to keep receipts from his spending of per diem. About a year later he was Told (Not in writing) that they would give him a taxable 400$ on his check to do what he pleases at the first of the month,…

Okay fine. All good…Now let me tell you that he was Told that he could spend his money on steaks and beer they just needed receipts. Now at the beginning of this new year they took away the 400$ at the beginning of the month and didn't say a thing. There is another coworker who is very upset by this, but my boyfriend let it roll off. The CEO of the company Told them (once again nothing in writing) that they cannot use the money if in town (Now this is where it gets even more sticky) my boyfriend can work at a fairly close neighboring town which qualifies as out of town per diem. He doesn't take a lunch so he usually uses that 60$ to take us out. NOPE can't do that anymore. Okay fine..I guess.
He was Told that he now needs to spend the money only when he is out of town. Okay again fine.. so we came up with buying groceries on last day while out of town. Now he uses these groceries to bring with them to work because sometimes they dont get off early enough to go somewhere and eat and shouldn't be left to eat burgers everyday.
He did this. 160$ worth, but was just told yesterday he couldn't do that and he owes 160$. Livid he gave back 100$ right then and there. I dont even think he got a receipt for it. I told him he was working the last day and shouldn't pay the 60$ For the day he was coming home. He bought some groceries when he was up there for a day or two ahead and they said it was fine, but coming back and getting food was not. Nothing has been in writing. Can they legally do this?
