Working around welders without proper eye protection

My fiancée recently started a job at a warehouse without even knowing he’d be working with welders. On his first day he was given gloves and clear safety glasses. Apparently he clamps down on whatever the welder has recently welded. Anyway the welders are supposed to keep their curtains up the whole time, but at lunch time he was caught off guard by a welder who started working right as he turned around, basically giving himself flash burn. Do these sound like safety violations? I thought if someone was around welders they would at-least need proper eye protection. Anyone who is informed about OSHA laws please let me know
