Hey so my wife works in logistics and was given a good promotion as a buyer 6 months ago. She understood that they had to fill her position and they finally have someone starting. She was told she would receive her new pay as soon as she was training the new guy and training in her new position. Today HR told her she would not be getting her new pay untill she was doing it 100%. They claim was that she would be switching from non-exempt to exempt and they cant due to FLSA. I call bull shit.
So basically my questions is
Going from non-exempt to exempt at same company to a different position but still working in non-exempt position. Can you get your exempt pay if not working in new position yet because company is holding you in non-exempt position for coverage reasons?
