Hey everyone. For a while I've been lurking here but I wanted to finally post here since I'd like to have some things cleared up when it comes to The Act.
I'm a supervisor at a Goodwill, it has a policy that says you're not allowed to discuss wages, doing so will end up in a pretty big punishment (writeup, possible firing). They say it's because if you make more than someone they might get jealous or some shit, I don't know. What I do know is that's not the real reason. I know this is illegal, since pay discussion is protected at the federal level. I asked the ASM to tell me why we can't, pretending I didn't know. She said that, and I replied by saying that discussion of pay is federally protected, she said I still shouldn't do it. Didn't say anything else because I didn't want to start anything, I was closing that night and didn't need the additional stress from it.
But if my knowledge is correct, supervisors or anyone in management are exempt from protection, due to the fact that they're the ones that are enforcing the policy. Although I wouldn't enforce it, I actually commend people there that do it. So my questions are—since I'm a supervisor, even if I don't enforce that policy, as well as other shady ones—if I get punished or even termed for it, would the NLRB be able to help me? What should I do?
