My husband has been recovering from a traumatic head injury since December 2022. His job was aware of this and that he logged his last time sheet in November of 2022. He’s been recovering and is planning to get back to work next month, but last week he got an email from HR saying that he has been getting paid full wages (despite not logging timesheets in their system) since December of 2022.
Sure enough, I check his bank account log and they’ve been sending paychecks. But neither of us were aware of this for months, and I’ve been using the funds per usual over these months between medical payments groceries etc. It’s our joint account that also gets my paychecks deposited in it, so I don’t monitor it and with all that’s been happening to my husband these months he also hasn’t been.
The total they paid him without him knowing or working is nearly $20K, and with our medical costs following his treatment there is no way we can pay all this back.
I’m devastated and can’t believe this is happening, we have been so caught up trying to get him walking and talking again over these months that I never bothered checking the bank statements in detail.
What can we do in this case? We live and work in NY, are there any protections? He never submitted timesheets and they still paid him since December 2022… we are lost and don’t know how to proceed. Any advice is tremendously welcome!
