Final Paycheck issue

Hi everyone, I need some advise on my final paycheck issue with my former employer. I turned in my 2 weeks notice in August and my last day was 8/18. I was supposed to get paid my last paycheck on 8/25, but didn't receive it. So I contacted my former employer and received a response on 8/30 that there was some issue with payroll processing software, and I would get paid on next pay day. I know by law that I was supposed to be paid on 8/25, but since I left the company in a good term, and it wasn't like I needed that money to survive, so I decided to wait. The next payday came and I still didn't get paid so I contacted my former boss and he just said he already talked to the person who handles the payroll, and please wait couple more days. And…

I need some advise on my final paycheck issue with my former employer.

I turned in my 2 weeks notice in August and my last day was 8/18.

I was supposed to get paid my last paycheck on 8/25, but didn't receive it.

So I contacted my former employer and received a response on 8/30 that there was some issue with payroll processing software, and I would get paid on next pay day.

I know by law that I was supposed to be paid on 8/25, but since I left the company in a good term, and it wasn't like I needed that money to survive, so I decided to wait.

And that was the last I ever heard from anyone.

I've sent several emails and texts, and I am not getting ANY response.

The issue is, my previous job is located in California, and I always worked from home in Texas.

Also, I was told that in California, employers are obligated to pay unused PTO, but my former employer said they don't have any policy on it, so I was not paid on that either.

Since I've always worked from home in Texas…

1) Which state should I contact to resolve this paycheck issue?

2) Am I still eligible to get paid for unused PTO?

I would really appreciate all the advise I can get.
