First off, please be kind. I am not well versed in employment/labor law, I am just going off of gut feeling and what I have seen posted here before.
Background: VERY small (<10 ppl) business, warehouse with hazardous materials
Let's start off with things I KNOW they are doing illegally. We have a lot of turn over due to shit pay and shit work. If an employee does not stay 6+ months, they charge them for their pre-employment testing ($275 total). When I brought up the specific law about this, they said it does not apply to them because they are a small business. Is that true?
Wage theft? I help calculate time cards, so I know exactly how they get figured and its different than any other job. Examples below:
7:00 = 7:00
7:01 = 7:01
7:02 = 7:02
7:03 = 7:03
7:04 = 7:04
7:05 = 7:05
7:06 – 7:15 = 7:15
I know that there is the 7/8 rounding, but it is supposed to be in favor of the employee, right? This is a whole ten minute window that gets rolled up, the same for break. For example: if you clock out on break for 30-35 mins, its the exact minutes, but if its 36 minutes, you get docked a 45 minute break.
Now onto the things I am not so sure about as I don't know how this stuff works as a business owner:
Almost everything they buy gets put on the company credit card and paid out of the company check book – the husbands comic books/marbles/antique collectibles, groceries, vet bills. Every time they eat out (every meal) or take the grandkids out to eat, it gets cash paid out through the company. All of their dry cleaning, all of the kitchen/cleaning supplies they buy for at home gets paid out of the cash drawer, even going so far as purchasing an airsoft gun for the grandkids and paying it out of the cash drawer and marking it “warehouse equip”. I've also cashed out his antique purchases that get filed under “marketing/merchandising”. I also understand that they have a vehicle insured as a company fleet vehicle that I have never seen on site and is instead used by the kids/grandkids ~1.5 hours away as a daily family commuter. I'm not trying to be petty or nosy, I just know they are doing a lot of things that seem shady to me, I just genuinely don't know what is/isn't “a thing” because anytime I ask, they say that the “regular” rules don't apply to them because they are a small business.
I am looking for a new job (and think I have one, fingers crossed) but what I want to know is, how do I go about reporting this? Can I make copies of something to turn into the DOL or is that stealing somehow? I know right before I got hired, they were audited and passed with 100% so that's part of why I am like – maybe all this is okay?
