My (now formal) employer told me last week that starting in November, I would be changed over to working as an Independent Contractor. My position doesn't fall in line with the guidelines as to what an Independent Contractor IS, so when presented this week with a new contact to sign, I explained that I didn't believe that the change was correct and said that I read on the IRS website that I should be considered a regular employee. My boss (there are only 3 other employees as it's a small business) said that I accepted the change or was fired. I asked them to tell me exactly why they were so adamant to make the change and they said that they were not interested in paying my taxes anymore and they also didn't want to pay the $50 a month fee for workers comp… and because I worked mainly from home, they didn't want to have to pay if I was injured and was off of business property. I told them that according to the IRS website, a business owner can't just decide who is an “employee” and who is an independent contractor and they laughed and said “go ahead and send the IRS to me, I know exactly what to say to them to get them off of my back”. …a few minutes later they said that they new they wouldn't convince me to sign the new contract and told me that we'd have to part ways. I said ok and left.
I'm wondering if anyone has any knowledge about this, about who I call… or what I should do. I am also in a “right to hire/fire” state in the United States.
