Brother died 3 months into a new job, need more than 5 days, but I’m not eligible for unpaid absence

Started a new job with a 6.5k lump sum bonus. However in the offer letter it requires me to pay it back if I leave within 12 months. Three months in my older brother dies at the age of 33. I just got back to work and I'm making mistakes left and right and I can't concentrate very well. I have to stay up late and force myself to do an okay job. I also can't take an unpaid absence until I have been with the company for 12 months. I honestly need more time off. I've already lost my mom, and I thoroughly regret not taking the time off back then. I can probably pay the lump sum back off, but I'd probably have to work for another month and budget accordingly to make sure I've got a solid savings to rely on while I grieve. Idk if there's…

Idk if there's anyway around it. The only time off I can take is flex time. And I can't take vacation till December, which is only three days.

I feel like my only option to get more time off is to quit. Given the company policies. What do you all think/recommend?
