Prevailing Wages

Hi all, Hoping for some help here. When we have prevailing wage work (NY), the company I work for deducts wages based on what we used of our FSA benefits from the previous year. I lost about $7/hr, a co worker had $33!. Is this legal and if so does our company get paid in full and then can pay us based on what they provide in benefits? The other kicker is our FSA is use it or lose it (we pay 25%). So if I use my FSA I get docked wages or don't use it at all I get full prevailing but I still lose my contribution. What is happening here? Besides my company are jerks.
