Reported employer to DOL, investigator showed up, hours cut, then given more dish shifts then fired today. Update: I was fired after I clocked out today.

I call the investigator back and she tells me that, “while the employer violated the no managers, owners or supervisors in the top pool final rule 2021, BOH isn’t eligible for protection or backpay because the business didn’t pull in 500k per year revenue. And that only the one cashier per shift will receive backpay because “they deal with credit cards which is interstate commerce.” I get home and immediately file for unemployment as well as attempting to report the employer for dol whistleblower retaliation termination. Still waiting on response from both. I feel like I exercised my assumed right, deemed correct but somehow indelible due to low sales, then left out to be deemed the whistle blower. Anyone been in this situation?
