Next step recoms for misclassification of workers?

Myself and other workers often get scheduled full time hours (32+) despite being PT on paper. When asked if we can be changed to FT, folks are often denied and retaliated against. There have also been instances of people getting FT verbally despite not getting a paper change. Should folks report to HR first and then the dept of labor? It seems like a way to deny people insurance.
