So my roommate got a new job as a technician servicing large engine vehicles. He's been on call nearly 24/7 since he got the job. This restricts him from, say, having a beer or spending time with his son.
Anyways, he isn't getting payed for these on-call hours, and his company is trying to say that it isn't mandatory. Seems fucking sus, tbh. I think he should be getting paid for these hours.
Is this legal? We're in California.
Edit: more context; he was on call for a hundred hours during his first week. He didn't get paid for those hours. He couldn't drink beers with us, had to coordinate with his ex to juggle the kid around, couldn't go to the DMV. I would call that restrictive on-call duty, but the company is trying to play it off like he wasn't actually working those hours.
