Battle with boss over PTO

Please help. He has contacted an attorney and I am basing my position on internet research. When a salary employee works a partial day, does employee have to take PTO for the missed hours? The DOL website says salaried employees can only be deducted PTO for a full missed day. The concept is we don’t get overtime so we can’t be docked for partial missed time. Thanks for any help
