I started a new job and I'm on day 2. I was written up for time theft on my second shift because I clocked in, then put my lunch bag / jacket in the break room. It was explained that clocking in means you're “ready to work” and if your clocking in before then, you're breaking the law. Yes I was on time.
At my last job this was never an issue. My manager said if you're required to be here you're required to be paid, I don't care what you do as long as you're here. He preferred we clocked in before squaring yourself away because you're still at work, so get paid.
So do I have any legal backing to fight this write up? Is this rule enough to care about? I'm definitely looking at going back to my old workplace because the new job sucks for more reasons than this but I don't know if I'm being childish or not. Any opinions appreciated
