Background info for those that don't know:
Holiday Pay doesn't count towards overtime so any week that we have a holiday in the worked hours go from 40 to 32. That means any time that you would normally think is OT on holiday weeks is not actually OT. Unless you manage to work back up to 40 worked hours, only then is any additional time considered OT. I probably did a terrible job explaining that.
Anyways, today our boss offered us to work late tonight. Specifically stating it was OT. This week is thanksgiving so I'll only be working 24hrs, making the extra hours I'm working not OT. This was clearly a simple mistake, nothing too nefarious. I was just wondering if there is anything illegal about offering us “OT” when it won't actually become overtime?
