Calling References Without Permission

A perspective employer emailed to update me on their timeline for hiring, and mentioned they were just in the process of calling references for me. I had not provided any references and immediately got a bad feeling. I am currently pursuing wrongful termination with my last employer, and especially don't want them to have any information on my movements. I responded asking specifically that nobody contact my last employer, which hopefully went without saying as they were aware of my situation. I also supplied 3 of my preferred references. I find out today that they continued to contact people outside of what I provided. They contacted a supervisor at one of my previous jobs, even though he wasn't my supervisor, and I had provided them with my supervisor as a reference. It makes me not want to work with them, but as time ticks on and I still have no employment I worry about being too picky. What do you guys think, is this enough of a red flag to avoid working with this company?
