I work for a privately owned movie theater as an “unofficial” Head of Customer Service. I have been with the company since 2018 and was brought back in mid-2021 as the sole customer service representative as we were in the process of reopening. My responsibilities include: – Responding to ticket inquiries through our help desk. – Outreach to guests who require further assistance. – Operating the phone calls for all four of our venues. – Management of past promotional material after Covid. But what’s expected of me goes beyond the above-mentioned responsibilities. I also serve as a manager/floor supervisor in addition to being the resident front desk associate. I am utilized as coverage for other departments including concessions, ushering, box office sales, and have even washed dishes when our dish washer never showed up. I work at a local cafe. They’ve been doing construction in our store for the past two months. They’ve doing a FULL remodel, ripping out the counters, new floors, etc. There’s been lots of health code violations and such and I was making due and slowly trying to look for a new job. This past week they were putting in new counters and there was a horrible epoxy smell. There were awful fumes. During that day all five employees working got sick. Vomiting, headache, dizziness, eye and throat irritation. I contacted my manager that I was throwing up from the fumes and needed to go home. She got there argued with me but let me and my coworker go home. Two hours later she called me and fired me. I asked for a letter of termination from her and it says I “voluntarily resigned”. Going by the first infographic that I saw posted: I work for someone else's business exclusively, I'm paid by the hour, I have a permanent/not temp job with them, the employer decides how and when the work will be performed (as callas are routed to me- we're an answering service), and the the employee assigns the calls (and which type of calls I receive). But I had to buy and use my own equipment. So the “buy and use my own equipment” is the only part of my job that would fall under contractor. They also provide 5 days a years of vacation pay but no other benefits at all. Shouldn't this make me a W2 and not 1099-NEC employee. At the location on military Rd I'm Benton Arkansas and aside from the manager and maintenance guy, everyone behind the counter is still in middle school based on their shirts and the fact that three of them are my neighbors kids and they are under 14.
