Situation as an employee in NY state

18 years old, NY state, just south of Rochester. I am a part-time employee at my college cafeteria, closing shift. I am sometimes kept past my scheduled clock-out time (11:45 PM), with pay (not qualifying for overtime). My employers claim that this is legal, they also claimed that they informed me upon hiring that closing time fluctuating is to be expected. However, I cannot find this in writing in the documents we are given upon hiring, and I do not remember being told this. I cannot find anything in the NY State labor laws or the Fair Labor Standards Act that addresses this type of scenario. Considering all this, can anyone tell me if what they are doing is legal or not? If you have sources for your information that would be great too. Worked for a restaurant that never let me have tips

The restaurant was in a wealthy area and people often tipped $15-50 sometimes $60-100 for big groups. I got paid $11/hr. At first $10/hr and when I asked for a raise they gave me $11/hr but fired other worker and made me work twice as hard to make up for the $1 raise. Most of the time, I was the only server. On weekends, we had part time people come and work. The registers even had a tip jar that said “tip for servers” and people who did take out orders would tip that way. My service was amazing that sometimes people would say “I tipped extra.” The owners had cameras and was monitoring from home if they weren’t at the restaurant. Boss says we’re not getting paid.

Received this email from my boss about how we won’t be getting paid this week. Apparently the company is so short on cash that they can’t do payroll. Waking up Monday and checking my bank account. If I haven’t been paid then I’m seriously considering not going in. Maybe calling in sick or just quitting.

When will we STRIKE!!??

I work hard, I get paid shit. Most of my income goes to rent. I pay 1,200 all told for rent, utilities, etc. I work in healthcare, and I see the problems there. Fat cats at the top get millions, and we the workers get their scraps. I'm angry. We did it a hundred years ago. When workers band together, we affect change. It's in our spirit as Americans to do this, we don't have to go quietly. People all over are angry over shit that all leads back to the Rupert Murdochs of the world. When will the general strike come? I will be there with you all.

Paycheck didn’t include PTO…again

I was sick last month and took a day of PTO, but when I got my paystub I noticed it was missing the pay for those hours. I notified my boss and they said they were sorry, and would add it to the next paycheck. It hasn’t happened before, so I didn’t push it and I decided to just wait. Well, the next pay period just happened and, surprise surprise, it wasn’t on there. Again. I brought it up immediately, and they said they would escalate it to HR. It’s not much, but they are now over a month late on paying me for that day. If I was in a paycheck to paycheck situation, this wouldn’t be acceptable. Is there any kind of penalty fee for this? I know there’s late fees on last paychecks, but this isn’t my last one, it’s just an incomplete one. I am in…
