Do OSHA violations apply to charter schools in New York?

I'm in a grad school program that's partnered with a residency school, so I'm working full time and I'm taking classes three nights a week. My manager has been getting on me recently for taking a lunch break. Our work day is from 8:00 am to 4:45pm, but it's an unwritten rule that we need to either come in early or stay late to get everything done. Do OSHA regulations apply in this case?
