I recently started work at a place we’ll call The Company. For my work with The Company, I have to drive (commute + a distance) miles round trip once a week, which The Company promised to reimburse all but (commute) miles of that trip at the California mileage rate. According to The Company’s own travel policy, mileage should be paid at the next pay period. The first time I submitted mileage, I received a “marked as paid” with my mileage being changed to 0 miles. I contacted my boss to complain about this, was forwarded to HR, and promptly ignored. Fast forward a month, and I’ve submitted two mileage reports. One of them was marked paid for this pay period, but I still have not been reimbursed for either. Does this fall under “wage theft,” and if not, assuming I get completely ignored by HR again, do I have any legal recourse to actually get reimbursed for the mileage I was promised? Is there a penalty for companies not reimbursing mileage on time?
