Hello,
I was fired from my job in nyc without notice on a Wednesday, two days before my approved two weeks PTO. My former employer has stated that they will not honer my PTO. They referred me to the employee handbook which I signed 3 years ago, which after reading through has the following sentence.
“Employees terminated involuntarily will forfeit all unused accrued PTO, unless otherwise covered by law.”
They also never gave me a termination letter or mention anything about unemployment.
They suggested I take up cobra in order to continue my medical insurance.
I was wondering if I have any legal grounds in pursuing my unpaid PTO/damages.
