Getting fired/disciplined for having a second job ?

Sorry in advance if this isn’t the right group to ask. Long story short I work for a dealership as a mechanic. We are located in Quebec , Canada . This dealership sells ABC cars and does service on them. Fixing engines, check engines, maintenance ect… that’s what I do. One of my co workers got taken into the office and got “caught” working on his personal time on a ABC car. There is a policy that we never knew about or signed up for that states “ABC requires pre-approval before salaried or exempt employees may engage in employment outside ABC. To obtain approval, employees must fill out the Outside Employment Authorization Form and submit it to their manager and local Human Resources representative. “ obviously this was not done as we didn’t know about it. Later on in the policy it is mentioned “The employee's manager and Human Resources…

Later on in the policy it is mentioned “The employee's manager and Human Resources representative must determine if outside employment is permissible by evaluating if the outside work: Appears to compromise or potentially compromises ABC' interests” and “Individuals who violate this policy or related laws may be subject to serious disciplinary action up to and including termination.”

My question is, if my co worker gets suspension no pay or gets fired is this even legal ? We are a international company and this policy might be applicable in some other state or country but maybe not everywhere ?
