PT Job pays 10 hrs per week regardless of how many hrs worked.

I have a job interview on Friday for a PT position as a Program Manager. The pay rate is not on the job description or but I believe it’s $35 or $40 per hour, which is WAY below average for a position like this. Also, they want to pay for 10 hrs a week – regardless of how many hrs worked – because they say some weeks will be more than 10 hrs and other weeks less than 10 hrs. Is this even legal in NY? And why not just pay me for the hours worked? I lost my job a few weeks ago and have $0 income coming in so I’m tempted to take whatever is offered but I don’t want to sell myself short or be taken advantage of, which has happened before. Any thoughts on this 10 hr a week proposition?
