The Labor Law investigator called and said I had no claim. He emailed me this:
1. You cannot reject an employers required meal period as that would be insubordination on your part with the companies policy, #2. PA does not require employers to pay employees for a meal period that last longer than 20 minutes, and you are not performing work. #3. (FLSA) Fair Labor Standards act, does not require meal or rest / break periods, however except for employees between the age of 14 and 17 and for seasonal farm workers.
- There was NO BREAK given. That's the issue. Number 2 doesn't apply because I never had any breaks, and number 3 is the only one that would apply. So basically, everyone in PA (and probably other states) can work continuously until they pass out with no breaks.
He ignored the wage theft entirely. I worked through all the unpaid hours.
Interestingly enough also is his title. Labor Law Investigator CFEI, CFII, CVFI, IAAI-ECT, CFI, BCO
Don't bother reporting if you are in this situation.
I was also denied UC benefits because I quit and wasn't terminated.
