I am currently working as a contractor for a financial firm through a temp agency & I am based in the US.
During my time here, it was made clear to me that overtime pay was not something that happened here. I likely work about 5-10 mins of overtime each week, on average but didn’t keep a record of this time.
On one occasion, the first time I worked overtime, about 1 hour, my time sheet was rejected by the financial firm when it exceed 40 hours. They explained that they did not have resources allocated for the project to pay any contractors for more than 40 hours and called me to talk about it.
I recorded this phone call and am in a one party state, which is the same state the employer is based in and called from as well. What my boss stated was that instead of paying me for 41hrs that they would allow me to take off one hour early the following week. I have this conversation saved. I believe this practice to be illegal as I was not paid proper overtime for the hours worked.
Do I have any legal recourse here? My main concerns are that I am employed through a temp agency & did not keep a record of other overtime pay missed.
