Bathrooms are unavailable at work

The building that I work in has frequent plumbing issues. For the third time this year, the water has been shut off and we are not able to use the bathrooms in the work building and we do not have access to water. My employer is allowing us to leave work to go use public restrooms at this time. Is my employer breaking any laws or are they in the clear since they are allowing us to leave throughout the day to access bathrooms? Edit: I live in TX in case that is necessary info.
