My husband was working for the local rescue mission (so essentially a church) he had worked there for like 2 months when I had our second baby and it ended in a really complicated cesarean that left me with a much higher recovery time and more pain than is typical of an uncomplicated cesarean.
He took his full 2 weeks of leave for the year. At the end he requested an additional 1 week of unpaid leave which was approved.
After this there were several instances of me needing him to take me to postpartum appointments and our son, who had multiple complications to his appointments. I was not supposed to drive for 15 weeks, which we still have not come to the end of. He also had to take the day a few times when i was unable to get up from pain.
Every single time he informed his supervisor, the director of the mission, of the need and was told it was fine. He was making up the time on the weekends even.
Then one day with no prior warning he walked into work and the entire board was there and they let him go, citing attendance.
We have contacted legal aid in our state but i know FMLA only applies to employees of 12 months or greater. Can anyone give me hope that we will find a resolution in our favor? We have 2 kids now, i still can’t work, and he is struggling to find any job that can pay our bills. Plus he didn’t get any insurance at the mission so I’m being hounded by debt collectors for my surgery and the time in the hospital. I’m so hopeless. I just hope someone can tell me there’s something to be done about this.
