Help! Resigned – Last Day Nov 15 in Hawaiian Company, no pro-rated 13th month pay upon resignation?

Hi! I'm so frustrated and upset 🙁 I've been with this HI company for almost 3 years and we've always been given 13th month bonus at the end of every year. I resigned this September with November 15th as my last day. And I just realized that in our policy, it states that pro-rated 13th month pay will not be given when employment is terminated before the bonus's release. May I know if employers have a right to do this? They've always been such great employers, but I'm so confused as to why this policy would be there. I'm from the Philippines, and our labor code legally requires employers to pay a pro-rated 13th month upon resigning. Is it different in the US? I'm hired as an offshore worker, I work from the PH and the company is in Hawai'i. Is there anything I can do to receive the pro-rated…
