Manager taking tips under the guise of Maitre D

To preface, I work in the front of house at a michelin star restaurant in San Francisco, CA. The FOH tips for each day are divvied up by an hourly percantage. One of the servers was promoted to a management position a couple of months ago, and remains on the tips. Raking in 2x more than the servers do each day because he comes in around 4 hours earlier than anyone else and then later closes the restaurant, as well as overtime hours which i assume effects his tip percentage. The FOH as a whole has recently sent an email to HR, Management, and a few of the restaurants larger shareholders that frequent the restaurant regarding our feelings on the situation as well as proof of the discrepancy, shown by the one day said manager had taken off and our tips for the day were quite literally double what they…

This week we were met with the typical divide and conquer strategy by HR and were told that said manager was considered a Maitre D, and allowed to remain on the tips. We have been gathering evidence and testimony that would contradict the Maitre D status, such as closing the restaurant every night, but I was wondering if there were any other courses of action or nontypical Maitre D behavior that we should be looking for.
