Break policy question

Hey all, Quick question, I'm in Ontario Canada. My employer has a policy, that our 1 hour break is paid for a 10 hour shift. However, their policy is also if you are late or miss punching in, you lose the paid portion of the break. I've had a few complaints from fellow employees that when they punch in on their phones, the GPS will bug out and not be able to locate them, causing them to punch in 1 minute late, and lose an entire hour of pay (the break is now unpaid) Does this constitute time theft or is just a policy they can enact since breaks aren't mandatory to be paid?
